I. GENERAL PROVISIONS

    1. The simons.com.pl shop operates on the terms and conditions set out in these regulations.
    2. The conditio for placing an Order in the Store by the Customer is to read the Regulations and accept its provisions at the time of placing an Order.
    3. The online shop carries out orders with shipment to Poland and other countries. When ordering from abroad – shipping conditions – in particular, the costs are given after selecting the destination country when placing the order.
    4. Information on foreign delivery is available at the following e-mail address: info@simons.com.pl.
    5. The products offerred in the shop are new, free from legal defects and have been legally placed on the Polish market.
    6. All trade names, product names and their logos used the shop’s website at simons.com.pl may be registered trademarks. All materials, descriptions and photos presented on the shops’s website are used for informational purposes.
    7. In matters not covered by these regulations, the following provisions shall apply:

    – act on the provision of electronic services of July 18,2002

    – the consumer rights act of May 30, 2014

    – the Civil Code Act of April 23, 1964

    – other relevant provisions of Polish law


II. DEFINITIONS

CONSUMER – an individual who performs a legal transaction with an entrepreneur not directly related to his business or professional activity.

  1. CUSTOMER – a Customer who intends to conclude or has concluded a Sales Agreement with the Seller.
  2. REGULATIONS – a set of regulations regulating the rules applicable when using this Store.
  3. STORE – the Service Provider’s online store operating at simons.com.pl
  4. SELLER, SERVICE PROVIDER – SIMON’S KNIVES MANUFACTURE, 21 Bielska St., postcode 43-356 Bujaków
  5. PRODUCT – a movable item available in the Store, which is the subject of the Sales Agreement between the Customer and Seller.
  6. SALES AGREEMENT – Product Sales Agreement concluded between the Customer and the Seller via the Store.
  7. NEWSLETTER – a service provided electornicallyby the seler, consisting in sending commercial and advertising information to the e-mail address provided by the interested party.
  8. ORDER – a declaration made electronically or by phone about the willingness to conclude a contract (ordering a product or service).

III CONDITIONS FOR CONCLUDING SALES AGREEMENTS

  1. The information on the Store’s website does not consitute an offer within the meaning of law. By placing an Order, the Customer submits an offer to buy a specific Product under the conditions specified in its description.
  2. The Product price shown on the Store’s website is given in Polish zlotys (PLN) and includes all components, including VAT. A product deliverd outside the European Union may result in being obliged by the Customer to pay a customs duty or appropriate tax in accordance with the regulations in force in the country of destination. For additional information, the customer is asked to contact the competent customs or excise authority. The price does not include delivery costs.
  3. The Store reserves the right to introduce new Products to the assortment and to conduct promotional campaigns on the Store’s website.
  4. The Product price shown on the Store’s website is biding at the time of placing the Order by the Customer. The price will not change regardless of price changes in the Store, which may occur for individual Products after the Customer place an Order.

IV. PAYMENT METHODS

  3. The Customer is obliged to pay the price under the Sales Agreement within 10 working days form the date of its conclusion.

V. COST, TIME AND METHODS OF DELIVERY

  1. The time and cost of delivery of the order depends on the selected delivery options, country and order total.
  2. Delivery in Poland depends on the individual regulations of the selected operator.

VI. COMPLAINTS

  1. The Seller is obliged to deliver the product that is the subject of the contract – without defects.
  2. The seller is liable under the warranty for physical defect that existed at the time of passing on the danger to the consumer or resulted from a cause inherent in the product sold at the same time – for a period of 2 years.
  3. The seller is released from liability under the warranty if the consumer knew about the defect at the time of concluding the contract.
  4. In the event of a defect or non-compliance of the delivered product with the contract, the consumer has the right to lodge a complaint.
  5. In order to submit a complaint, we recommend that the consumer completes the Complaint Form (Appendix 1) and sends the application by e-mail or by post to the seller’s correspondence address.
  6. Simon’s Knives Manufacture will consider the complaint without undue delay. However, no later than within 14 calendar days from the date of receiving the complaint, the Customer will be informed electronically about the status of the complaint.
  7. If the complaint is accepted, the Customer will receive the product (repaired or new), and if it proves impossible, the cost of the defective product will be reimbursed.
  8. If the complaint is not accepted, the product will be sent back together with the information that the complaint in not justified.

VII. THE RIGHT TO WITHDRAW FROM THE CONTRACT

  1. Pursuant to Art.27 of the Consumer Rights Act, the Consumer concluding a distance contract, has the right to withdraw from the contract without giving any reason – within 14 calendar days from the date of taking possession of the product. In the event of withdrawal form the contract, the consumer is entitled to reimbursement of the costs incurred. If, at the time of concluding the contract, the consumer chose a method of delivering the products other than the cheapest standard method offered by the seller – the seller is not obliged to reimburse the consumer for additional costs that exceed the cheapest method of delivery. The condition for meeting the deadline is submitting a declaration of withdrawal from the contract to the seller. The declaration sent electronically is also important – you can use the ready form (Annex 2).
  2. Within 14 calendar days, the Customer will receive a refund for the payments made by them, including the cost of delivering the product to the Customer. The payment will be refunded using the same payment methods that were used in the original transaction.

VIII. FINAL PROVISIONS

  1. Agreements concluded through the Store are concluded in accordance with the Polish law.
  2. In the event of non-compliance of any part of the Regulations with applicable law , the relevant provisions of Polish law shall apply in place of the challenged provision of the Regulations.
  3. Any disputes arising from the Sales Agreements between the Store and Consumers will be settled by negotiation, with the intention of amicable settlement of the dispute. However, if this would not be possible or would be unsatisfactory for either party, disputes will be resolved by a competent common court.
